The Girgenti/Madden Bill A2309/S911 which upgraded penalties for assaulting nurses or other healthcare workers was signed into law on January 5, 2011.
The law upgrades the offenses for any individual who assaults a nurse or any other healthcare professional while in the performance of their duties from a simple assault to an aggravated assault. If bodily injury occurs as a result of the assault it will be classified as a third degree crime. A third degree crime is punishable by a term of imprisonment of three to five years,a fine up to $15,000 or both.
The New Jersey Nurses Association thanks the supporters of the important bill.
Purpose
- To enhance the professional practice of emergency nursing through a focus on public advocacy, education, leadership, consultation, legislation and illness/injury prevention.
